A compliance officer in a limited liability partnership (\u201cLLP<\/strong>\u201d) plays a crucial role in ensuring that the LLP operates in compliance with statutory requirements. In Malaysia, these responsibilities are expressly prescribed under the Limited Liability Partnerships Act 2012 (\u201cLLP Act 2012<\/strong>\u201d). It is therefore essential for any person assuming this position to have an understanding of both the responsibilities and the personal liabilities that may arise from non-compliance.

Responsibilities<\/strong>

According to Section 27(7) of the LLP Act 2012, a compliance officer shall be:<\/p>\n\n\n\n

(a) answerable for the doing of all acts, matters and things as are required to be done by the LLP under sections 17, 19 and 20; and

(b) personally liable to all penalties including administrative penalties imposed on the LLP for any contravention of those sections unless he satisfies the court hearing the matter that he should not be so liable.<\/p>\n\n\n\n
